MUNCIPAL TEACHERS - PROMOTIONS SCHEDULE

I invite your attention to the reference cited and submit that in the reference

1· cited the Government has advised to take necessary action for effecting promotions for the posts of Head Master/Head Mistress and School Assistant as per relevant rules and special rules issued in respect of Municipal Teachers covered the conditions of service including promotions. Accordingly, a schedule was given to the RDMAs and Commissioners of GVMC and VMC for effecting promotions to the category of Head Master/ Head Mistress in the high schools in the reference 2cited. The said scheduled was withheld due to MCC in view of ordinary and casual vacancies elections in certain ULBs and MLC elections in 8 districts.

2. Further, it is inform that certain SGTs, who possessed Language Pandit qualifications, have approached the Hon'ble High Court of AP and filed W.P. Nos.12344, 12505, 12509 of 2019 to consider them for promotion to the post of School Assistant (Languages) and the Hon'ble High Court of AP., in it's Common Order dated 03.09.2019 has disposed the above W.Ps and directed to consider the cases of the Petitioners for promotion to the post of School Assistants (Language) in the vacancies arose prior to 10.10.2017, if they are eligible and qualified, as per pre• amended rules issued in G.O.Ms.No.322 dated 07.12.2016 and G.O.Ms.No.320, dated 07.12.2016 and G.O.Ms.No.324, dated 07.12.2016 of Education Department.

3. Aggrieved with the above orders, certain School Assistants (Languages) have approached the Hon'ble High Court of AP and filed certain Writ Appeals Nos.

358,359,360 and 372 of 2019 and in WA.No.358 of 2019, the Hon'ble High Court of AP has issued "status-quo" vide orders dated 29.10.2019. Further, the above Writ Appeals Nos. 358,359 and 360 of 2019 came up for hearing on 30.09.2021 and posted the matter after Dussehra Vacation 2021 (as per online, the cases listed on 28.10.2021). Hence, the subject matter will be taken after final orders received from

the Hon'ble High Court of AP in the above WAs •

Further, it is to inform that Sri S. Sreenivasa Rao, S/o S.Sankara Rao has filed a WP No.20767 of 2021 before the Hon'ble High Court of AP. The Hon'ble High Court of AP in its orders dated 28.09.2021 has passed an interim order that any promotion is made in the interregnum period will be subject to result of the Writ Petition.

Since the above Writ Appeals Nos. 358,359,360 of 2019 and WP No.20767 of 2021 are pending before the Hon'ble High Court of AP, all the ROMAs in the State and the Commissioners of Greater Visakhapatnam Municipal Corporation and Vijayawada Municipal Corporation are hereby instructed to take further necessary action for effecting promotions to the categories of LFL Headmaster and School Assistant (Mathematics, Physical Science, Biological Science, Social Studies, English and Physical Education) except School Assistants {Telugu, Hindi, Urdu, Oriya, Tamil, Kannada, Sanskrit) in the available vacancies as per the rules and procedure in vogue and keeping in view of the instructions/clarifications issued by the Government and this office from time, subject to final outcome of OAs/WPs/RPs/CCs/SLPs etc., if any pending before the various judicial forums, duly following the below schedule, without fail.
