Family pension receiving Widowed &Divorced Daughters .Order given to government and treasury officials.

Widowed widow pension & Divorced Daughters పొందుతున్న ఫామిలీ పెన్షన్ ను నిలుపుదల చేస్తూ ఆంధ్రప్రదేశ్ ప్రభుత్వం ఇచ్చిన ఉత్తర్వులు GO.152 dt.25.11.2019 (45years age restriction) ను కొట్టివేస్తూ గౌరవ హైకోర్టు 5.03.2021 తీర్పు ఇచ్చిన నేపథ్యంలో....ప్రభుత్వం, ట్రీజరీ అధికారులకు ఇచ్చిన ఉత్తర్వులు.

సదరు ఉత్తర్వుల మేరకు వారికి నవంబర్ 2021నుండి ఫ్యామిలీ పెన్షన్ మంజూరు చేస్తూ..6%వడ్డీ తో అక్టోబర్ 2021 వరకు 6 సమాన వాయిదాల ప్రకారం డిసెంబర్ మాసం నుండి మంజూరు చేయాలి.

"In the wake of the Hon'ble High Court's 5.03.2021 verdict dismissing the Andhra Pradesh government's order GO.152 dt.25.11.2019 (45years age restriction) to stay the family pension being received by Widowed &Divorced Daughters.... Order given to government and treasury officials.

According to the order, they have been granted family pension from November 2021. 6% interest to be sanctioned from December as per 6 equal installments till October 2021."

The operative portion of the common orders read as follows:

" The executive instructions will not override or prevail over the statute or statutory rules framed exercising power under Article 309 of the Constitution of India and that the G.O. Ms. No.152, Finance (HR.III -- Pension) Department, dated 25.11.2019 is violative of Articles 14, 21 and 300-A of the Constitution of India.

In the result, the writ petitions are allowed setting aside the G. 0. Ms. No.152, Finance (HR-III -- Pension) Department, dated 25.11.2019 making it clear that the respondents shall continue to pay the family pension to the petitioners as paid to them earlier. Further, the State Government I respondents are directed to pay the arrears of family pension to the petitioners with interest at the rate of 6% per annum, from the day on which the family pension was stopped to them, within two (2) months from today. No costs."
